I am writing to you to complain about the quality of the product you supplied me. It has never worked properly and has several major defects.
1. The screws on the underside are not the correct size, and they kept falling out of their own accord. This presented a choking hazard for my young son. I have had to replace several of them with bigger screws so they grip properly.
2. The sound system is not working properly. It plays at various speeds and sometimes does not work atall.
3. The battery no longer charges. The charging indication light comes on sometimes when the cable is wiggled around.
I would like to thank you for sending me various components to resolve the problems. Unfortunately, these parts have not resolved the issues.
I requested a full refund and you refused to oblige. I understand through the sale of goods act (as amended 1979) you are entitled to the opportunity to repair or replace the item. Therefore, if you now supply me a fully working identical replacement you will have fulfilled your obligation to me. If this is what you decide to do then this will be acceptable to me. If the replacement item also breaks down the Sale of goods act would infer I have been “Significantly Inconvenienced” and I would then be entitled to a full refund. Given the quality of the goods I think it is likely to break down again.
I have a suggestion of a different solution that would be acceptable to me. If you keep the faulty car and issue a payment to me of £90 through Paypal I would consider this matter fully resolved. Given that I paid £120 originally and will have to pay a further £20 to return the faulty item I would end up £50 out of pocket in this case. I’m sure you could re-sell the car once you have repaired it.
